Residents of student dormitories consume gas for their personal domestic needs, although the educational institution is the entity and procures gas at rates higher than domestic. The member of the Parliament Valeriy Pysarenko suggests changing this order.
Respective bill №6069 “On amendments to the Law of Ukraine “On the natural gas market” regarding the exercise of the rights of the residents of dormitories as domestic consumers” was already registered in the Parliament.
The bill proposes to amend the Law of Ukraine “On the natural gas market” and to refer the residents of dormitories to domestic consumers. According to the initiators, it will reduce the pressure on the local budgets.
“As of the 1st of January 2017, local budgets are responsible for financing of the costs for utilities and energy and maintenance of educational institutions. According to the planned changes in the system of redistribution of funding, local budgets have a big pressure. The prospect of financial self-sufficiency of local government consists of the transfer of relevant sources of coverage from the state budget to local budgets and of the review of certain provisions of the current legislation, in particular provision of the Law of Ukraine “On the natural gas market” in particular extension of the definition of domestic consumers category”, - the explanatory note said.
It also says that the majority of educational institutions have dormitories in their structural units. Dormitories use the natural gas exclusively for cooking, heating water and do not include professional and commercial activity. In other words, the natural gas in dormitories is used for personal domestic needs of the residents.
According to the provisions of the Law of Ukraine “On the natural gas market” the domestic consumer – is a physical person, who purchases the natural gas to use for their own domestic purposes, including for cooking, water heating and heating of their living premises and does not include commercial activity.
The educational institution is an entity, so the purchase of the natural gas for the needs of dormitories is performed as the purchase by the legal entity and according to the provisions of the current Law cannot be associated as the purchase for domestic customers.
In this regard, Valeriy Pysarenko proposes to amend the Law of Ukraine “On the natural gas market” in particular the provision which refers the procurement of the natural gas for the maintenance of dormitories to the category of domestic consumption.
