The Member of the Parliament Valeriy Pysarenko offers to return the number of regulations repealed in December last year, which are related to scholarship for certain categories of students.
The relevant Draft Law dated 18.01.2017 on amendments to some legislative acts of Ukraine concerning the restoration of violated rights of students № 5654 was registered in the Verkhovna Rada.
The Draft Law proposes to amend the Laws of Ukraine "On the basis social protection of disabled people"; "On the status and social protection of citizens affected by the consequences of Chernobyl disaster"; "On the promotion of the social development of young people"; "On ensuring organizational and legal conditions for social protection of orphans and children deprived of parental care"; "On raising the prestige of miner work" and "On Higher Education".
According to opinion of the author of the document, constitutionally guaranteed rights of students to receive scholarships were canceled and made dependent on the decisions of the Government by the Law "On Amendments to Some Legislative Acts of Ukraine" dated 06.12.2016 № 1774.
In particular, the regulations on establishing the amount of the scholarship fund of the higher educational institutions were canceled. Mentioned regulations should ensure payment of academic scholarship of at least two-thirds and no more than 75 per cent of students (cadets of non-military institutions of higher education) of full-time education who are studying for the state budget, excluding those who receive social grants.
At the same time the regulation according to which by law was fixed minimum amount of the academic and social scholarship for applicants of educational levels of higher education, which cannot be less than the subsistence minimum wage per person per month, and the minimum academic and social scholarship for applicants associate of Bachelor degree, which cannot be less than two-thirds of the subsistence minimum wage per person per month.
In addition, the state-guaranteed rights for an increased scholarship for children and people affected by consequences of the Chernobyl disaster (amendments to the Law of Ukraine "On the status and social protection of citizens who suffered from consequences of the Chernobyl disaster") for orphans and children deprived of parental care and those among them (amendments to the Law of Ukraine "On ensuring organizational and legal conditions for social protection of orphans and children deprived of parental care").
Draft Law № 5654 provides the return of the regulations to the previous version and specifications of regulations in respect to increased scholarships. According to opinion of Member of the Parliament adoption of the Law will contribute to restoration of the students` rights for the proper scholarship support.
