Valeriy Pysarenko advocates for retaining of judicial candidates reserve


People's deputy of Ukraine Valeriy Pysarenko suggests to retain a reserve of candidates for the position of judge and to protect the rights of reservists who are at risk of exclusion from the reserve. The Member of the Parliament registered the appropriate draft law in the Verkhovna Rada of Ukraine, supporting the petition of Ukrainians on the official website of the President of Ukraine. (№ 2 2 / 0 2 7 8 5 3 -еп).


"As of 28th of July 2016, there are 452 candidates in the reserve. Since the provisions of the Law of Ukraine “On the judicial system and status of judges” provides for three years validity of qualification assessment results, on the 23rd ofDecember these candidates will lose the right to be appointed to the position of judge as a result of their exclusion from the reserve.

Unfortunately, within a period from the end of the year 2013 till present time, the majority of candidates have never managed to exercise their rights to take a vacant position as a judge due to the lack of competition and long continued unexercised powers on the part of the commission.

Thus, the candidates, who passed the transparent selection procedure according to European standards and passed qualifying examination, objectively had no opportunity to participate in the competition to fill vacant positions of judges with further appointment to this position", – says the petition.

According to Valeriy Pysarenko's opinion, the need to retain a reserve of the candidates for the position of judge is also caused by the availability of big number of vacancies as a result of dismissals of judges as well as by rational use of the budget funds.

Therefore, Valeriy Pysarenko suggests to amend the Law of Ukraine "On Judicial System and Status of Judges", providing an opportunity to the candidates of “third selection” after the expiry of the qualifying examination results (within 90 days after the entry into force of this Law), to participate in the competition without passing screening examination and special training. Such candidates can repeat the examination and participate in the competition to fill the position of judge in accordance with the results of such examination.

Adoption of the draft law will ensure protection of candidates’ rights for the position of judge and will provide the judicial branch with qualified personnel, says the People’s Deputy.
